美国Suniva公司去年底扩产后，并没有实际投入生产，于今年4月就进入破产重组，并向美政府提起201保障措施调查。

一旦美政府立案调查并最终采取措施，将直接影响各国光伏企业对美贸易。

美国国内光伏厂商目前的产量远不能满足美本土市场需求，中国机电产品进出口商会认为美国若对来自全球的光伏产品采取保障措施，将直接损害美国上下游企业和消费者的利益、影响美国国内就业并严重阻碍全球新能源发展和利用。

美国Suniva公司申请201保障措施已受到美国上下游企业和用户的反对，也受到各国光伏企业的反对。

几年来，中国机电产品进出口商会在政府支持下，组织中国光伏企业应对美国光伏“双反”、欧盟“双反”以及加拿大、印度、澳大利亚、土耳其等贸易救济案件。在此，我们声明：

这是个别企业为自身利益，滥用贸易救济条款的行为，中国光伏行业对此表示坚决反对。近期，我会代表中国光伏行业与Suniva公司最大股东及债权人举行了多次会谈，我们希望美国Suniva公司股东及债权人能从大局出发，立即撤案。201条款，改变不了企业内部的问题。

我们呼吁，美国际贸易委员会能够从美国上下游企业和用户的利益出发、从美国光伏能源市场实际出发、从维护与各国正常贸易出发、从发展人类新能源事业出发，妥善处理此事。

Declaration on the Section 201 Petition Filed by the US Industry

On April 26th , 2017 local time, US solar manufacture Suniva filed a Section 201 petition at the US International Trade Committee（ITC）against the solar cells and modules imports from all over the world. 

The producing capacity of Suniva was expanded last year but was not put into actual production. It applied for bankruptcy this April and then filed the Section 201 petition to the US ITC.

Once the US authority initiates the investigation and imposes measures eventually, the solar product trade between US and all the other countries will be influenced.

The current capacity of the US domestic manufacturers is far from meeting the demands in the US market. CCCME considers if US imposes the safeguard measures against all the products produced outside US, it will harm the interest of downstream and upstream companies as well as customers in the US, adversely impact US employment and impede the development and utilization of the clean energy globally. 

The Section 201 petition filed by Suniva has received objections from US downstream and upstream companies, customers as well as solar companies in other countries. 

In recent years, CCCME has organized Chinese Solar companies to defend in the trade remedy investigations from US, EU, Canada, India, Australia and Turkey with the support of the Chinese government. 

Hereby we declare that:

This is the abuse of trade remedy measures by an individual company for its own interest. Chinese solar industry is strongly against this action. Recently, on behalf of Chinese solar industry, CCCME has held several meetings with Suniva’s biggest shareholder and creditor, we hope Suniva’s shareholders and creditors can look at the whole picture and withdraw the petition immediately. Section 201 petition can not solve a company’s internal problem.

We call for US ITC to fully take consideration of the interest of downstream and upstream companies and customers, the reality of the US solar market, the maintenance of the normal trade between countries and the development of new energy of the human kind to solve this issue properly.
